The ERISA Claims Process
- Preparing and filing your ERISA claim: Careful and correct claim preparation is absolutely essential to success. Claims forms and your medical forms should be carefully prepared and reviewed at this stage. We can help you obtain the proper claims forms from your insurer or human resources department, work with your doctor, gather medical records and secure other information which supports your diagnosis while explaining how your ability to work has been limited.
- Benefits determination and notice: After the claim has been filed, insurers must make their decision within a certain specified amount of time and provide you with proper notice.
If benefits are denied, the notice must include the specific reasons for the adverse determination, a statement that the claimant is entitled to bring suit in federal court after exhausting the internal process and other information. At this time, you will want to exercise your right to obtain copies of all documents the insurer relied upon in denying benefits.
- ERISA appeals: ERISA appeals must be filed within 180 days from the date you receive notice of the denial of your claim. If any evidence including important medical records or reports are not submitted during your ERISA appeal, it will not be considered by a court later if litigation is necessary.
