What The ALJ Hearing Entails

The request to have your disability claim reviewed and ruled on by an administrative law judge (ALJ) comes after the reconsideration stage of the SSD appeals process. The attendees of this meeting include yourself, your attorney, the ALJ and usually a judicial staff member. On occasion, a vocational witness, a physician or other witnesses may be called into the room to testify. Others, such as family and friends, can be in the room only with your permission.

During the hearing, the judge will ask informal questions in a way that is not meant to be intimidating nor adversarial. The judge’s job is simply to make the best decision based on the facts. The Appeals Council Review And Federal Court Appeals

If you do not prevail in the ALJ hearing, we can request a review by the Social Security Appeals Council. Although there is no hearing at this level, we can present arguments and, in some cases, submit new and material medical evidence. If the Appeals Council denies your request, we may take your case to federal court.
