Capable Representation During ALJ Hearings And Appeals
The process of obtaining Social Security Disability (SSD) or Supplemental Security Income (SSI) benefits can be very difficult, even for people with obvious disabilities. Often, success only comes through perseverance during the appeals process.
At The Law Offices of Steven Gaechter, our New Jersey SSD appeals attorney can answer any questions you have, prepare you for what to expect and provide you with the quality representation that comes with having 30 years of legal experience. Call our law office to schedule a free initial consultation to discuss your situation.
What The ALJ Hearing Entails
The request to have your disability claim reviewed and ruled on by an administrative law judge (ALJ) comes after the reconsideration stage of the SSD appeals process. The attendees of this meeting include yourself, your attorney, the ALJ and usually a judicial staff member. On occasion, a vocational witness, a physician or other witnesses may be called into the room to testify. Others, such as family and friends, can be in the room only with your permission.
During the hearing, the judge will ask informal questions in a way that is not meant to be intimidating nor adversarial. The judge’s job is simply to make the best decision based on the facts. As a veteran of hundreds of hearings, attorney Steven Gaechter will do a thorough job of preparing you for your appearance before an ALJ. He can also effectively present evidence that ALJs look for when making an approval or denial determination.
The Appeals Council Review And Federal Court Appeals
If you do not prevail in the ALJ hearing, we can request a review by the Social Security Appeals Council. Although there is no hearing at this level, we can present arguments and, in some cases, submit new and material medical evidence. If the Appeals Council denies your request, we may take your case to federal court.
When you retain the services of our Bergen County law firm, you will receive the benefit of our experience with the federal appeals process. Attorney Gaechter has represented plaintiffs in more than 100 disability-related cases filed in New Jersey federal courts.
